Dave Walton (Tim Holt) becomes a deputy to assist his uncle Sheriff Sam Walton (J. Merrill Holmes) who has been wounded in a gun battle with Luke Archer , who was killed. Archer leaves a will providing that any ex-con can win a homestead race for his lands. Gil Carse (Roy Barcroft), executor of the will, soon has the town filled with hard characters as claimants. Dave as his pals, Smokey (Ray Whitley) and Whooper (Lee "Lasses" White), soon find that the only decent claimants are "Dad" Cook (John Elliott, his daughter Mary (Janet Walso) and a reformed pickpocket/safe-cracker named Pinky Gardner (Hobart Cavanaugh). Mary is put out of the race by Carse's henchmen, but Dave, on a trick bet wins Carse's fastest horse and gives to to Cook. As Carse's henchmen try to get Cook out of the race,Dave and his two pals arrive in time to shoot it out with the gang and arrest the survivors.
Luke Archer's will stipulates that his huge land holding will be open for filing, but only to ex-convicts who served at least two years in prison. This brings a large criminal element to town but the real crooks are Archer's Lawyer Carse and his henchmen. Dave and his deputies are aided by ex-safecracker Pinky who uses his skills to learn of Carse's plan.
Saw this for the first time the evening of March 11, 2004 on TCM. Lee "Lasses" White is a bit hard to take, but Hobart Cavanaugh is great! It was also nice to see Roy Barcroft and Tom London again, doing their thing together, too. When you think of Tim Holt going on to play in "Treasure of Sierra Madre,", Tom London with a role in "Twelve Noon", and Barcroft as the Sheriff in the film version of "Oklahoma", and the radio performer Janet Waldo, all of whom are in this one... along with great music by Whitley, it is very entertaining...and quite witty, too. The only other movies like this, from this time and this genre, that are as entertaining are the Gene Autry films of the early 1940's. But I liked this cast better than those used in most Autry flicks.
